About ACBAR:

The Agency Coordinating Body for Afghan Relief & Development (ACBAR) is a national, independent, non-government organization (NGO) that provides a platform for information-sharing and networking for national and international NGOs in Afghanistan. ACBAR was created in Peshawar, Pakistan, in August 1988 in response to the demand from NGOs working with Afghan refugees in Pakistan and across the border in Afghanistan to coordinate assistance and delivery of services more efficiently. ACBAR’s main office or secretariat has been based in Kabul since 2002.  ACBAR brings together 193 National and International NGOs working in in all sectors of humanitarian assistance and development in Afghanistan. ACBAR also has five provincial offices in Jalalabad, Mazar-e-Sherif, Herat, Kunduz and Kandahar.

ACBAR’s key activities focus on three pillars, namely: (i) information sharing and coordination, (ii) advocacy/engagement with NGO members, the government, UN, donors and wider civil society and (iii) capacity building of NGOs.  All of ACBAR’s work is in furtherance of provision of timely, high-quality, efficient and equitable provision of needed goods and services to vulnerable populations in Afghanistan.

JOB SUMMARY:

The ACBAR Senior Legal Compliance officer works to assist both the ACBAR Director and the ACBAR Deputy Director to carry out their work. The Senior Legal Compliance officer, under the immediate supervision of the ACBAR Deputy Director and Director, will carry out programming, planning- and/or representational-related tasks identified by the ACBAR Director and/or ACBAR Deputy Director. The Senior Legal Compliance officer will serve as a key member of the ACBAR senior management team, who will be counted on to help ensure the smooth, efficient and strategic operation of the overall ACBAR program

ESSENTIAL TASKS

Essential tasks include the following:

Legal Affairs:

  • Review all legal related documents to ensure suitability
  • Provide legal advice to agency members in light of enforced laws, regulation, international accepted standards and norms.
  • As an in-house lawyer, to handle legal matters/issues and to serve the interest of organization.
  • Advising the organization on the legislation that affect the organization and changes made thereof.
  • Review, and negotiation for contracts (venders’ contracts).
  • Review and draft contracts, agreements and internal policies and ensure that they are in compliance with all statutory or legal requirements.
  • Assisting the management (Director/Deputy Director) in all matters pertaining legal aspects.
  • Interpreting laws, regulations, and policies to advise organization and team members about how these apply in a working environment.
  • Offer legal guidance and advice to member organizations as/when required.

Compliance:

  • Review policies to ensure they are in compliance with Afghan laws
  • Support the enforcement of policies  
  • Coordinating the organization’s internal complaint management system.
  • Monitoring compliance with legal and statutory requirements of the organization and Afghan laws.
  • Providing necessary support in the board secretarial function.

Programming:

  • Backstopping for senior managers
  • Represent ACBAR in meetings, when/as required.

Administration:

  • Backstopping for senior managers, when/as required
  • Perform any other task as requested by Line Manager and/or Senior Management including assisting colleagues in other departments.

Job Requirements:

EDUCATION, TRAINING and/or EXPERIENCE

LLB graduate, or other relevant field of study.
A minimum of four (4) years relevant work experience in public service, NGOs or Private sector, Experience in humanitarian matters/operations

LANGUAGE SKILLS, MATHEMATICAL SKILLS AND REASONING ABILITY:

Ability to visit and conduct face to face meetings
Ability to speak and write English, Dari and Pashto
Ability to work in a team and attentions to the details

Knowledge, Skills and Abilities: 

Observation, active listening and analysis skills with ability to make sound judgment
Good interpersonal skills and the ability to interact effectively with diverse groups
Proactive, results-oriented and service-oriented.
