Job Description:
Job Summary
The Legal Advisor for large-scale Mining Contracts provides expert legal guidance on the drafting, negotiation, review, and enforcement of mining agreements. The role ensures that all mining operations are in compliance with national legislation, international best practices, and policy objectives of the Ministry. The Advisor also supports transparency, legal risk mitigation, and sustainable resource development for large-scale mining contracts.
Duties & Responsibilities
- Legal Advisory and Compliance:
Advise the Ministry on legal frameworks related to mining, including licensing, concessions, royalties, and environmental obligations.
Ensure all mining contracts comply with national laws and international legal obligations.
Provide opinions on legal risks, regulatory impacts, and dispute resolution mechanisms.
- Contract Development and Review:
Draft, review, and negotiate mining contracts, including exploration and exploitation agreements, joint ventures, and public-private partnerships.
Ensure contracts reflect the Ministry's strategic interests, policy priorities, and good governance principles.
Coordinate with technical and financial teams to ensure contract terms are comprehensive and enforceable.
- Regulatory Support:
Support the development and revision of mining laws, regulations, and model contracts.
Participate in public consultations, inter-agency legal harmonization, and international treaty reviews.
- Dispute Management:
Support the resolution of legal disputes with mining companies through litigation, arbitration, or negotiated settlements.
Represent or assist in representing the Ministry in legal proceedings or negotiations.
- Capacity Building and Governance:
Build internal capacity on contract law and mining regulation through training and mentorship.
Promote transparency and anti-corruption standards in contractual practices.
- Stakeholder Engagement:
Engage with investors, legal firms, and international partners to promote a fair and attractive legal environment for mining.
8. Advise and assist LSMMD in any tasks assigned by the LSMMD based on the laws, regulations, and objectives of the organization.

Job Requirements:
Job Requirements
- Master’s Degree in Law (LL.M. preferred) with specialization in natural resource law, commercial law, or international investment law.
- Seven years of work experience required for a Bachelor's degree and five years for a Master's degree in relevant fields.
- experience in legal advisory roles, preferably in mining or extractive industries.
- Demonstrated experience with mining contracts, licensing processes, and legal negotiations.
- Strong legal drafting and negotiation skills.
- Excellent communication skills
- Strong reporting, coordination, and monitoring skills.
- Proficiency in MS Office, Excel, and contract/project management tools.
- Fluent in English and one national language (Dari or Pashto); fluency in both is a strong asset.
