Job Description:
A. Department Establishment & System Development
• Establish the Legal and Compliance Department, defining its structure, roles, and responsibilities.
• Develop, implement, and maintain a comprehensive compliance framework covering all organizational operations.
• Create a centralized system for legal documents, contracts, policies, and compliance records.
• Draft standard operating procedures (SOPs) for legal review, policy implementation, incident reporting, and compliance monitoring.
B. Legal Advisory & Support
• Provide internal legal advice on contracts, MoUs, agreements, employment contracts, leases, procurement agreements, and other organizational matters.
• Ensure compliance with Afghan laws, NGO regulations, and international standards.
• Represent the organization in legal proceedings and liaise with external counsel as required.
• Maintain valid NGO registration and act as liaison with government authorities.
C. Compliance Management & Monitoring
• Monitor adherence to national laws (labor, tax, NGO registration) and donor grant conditions.
• Conduct internal compliance audits and implement corrective actions for identified gaps.
• Establish and manage a whistleblower system, investigating and resolving reported compliance breaches.
• Ensure all program and operational activities comply with donor agreements.
D. Policy Development & Management
• Lead the development, review, and updating of key policies including: Code of Conduct, Anti-Corruption and Anti-Fraud, Conflict of Interest, Safeguarding/Child Protection, Data Protection, and Risk Management.
• Ensure policies are clearly communicated, accessible, and implemented across all staff.
E. Risk Management
• Develop and maintain an organizational risk register identifying legal, operational, financial, and reputational risks.
• Collaborate with department heads to design and implement mitigation strategies.
• Provide regular risk assessment reports to the Executive Director and senior management.
F. Training & Capacity Building
• Design and deliver training programs for staff and partners on legal compliance, donor regulations, ethics, anti-corruption, and safeguarding.
• Conduct onboarding sessions for new staff regarding compliance expectations.
• Provide ongoing guidance to departments to ensure compliance obligations are met.
G. Reporting & Documentation
• Prepare regular compliance and risk management reports for senior management and donors.
• Develop templates for incident reporting, audits, and risk assessments.
• Maintain organized and secure records of all contracts, policies, registration certificates, and compliance documentation.
H. External Liaison & Coordination
• Serve as the primary contact with government authorities for NGO registration, tax filings, labor law compliance, and other legal matters.
• Coordinate with donors to meet reporting and compliance requirements.
• Liaise with external auditors during financial and compliance audits.
I. Continuous Improvement
• Stay updated on Afghan legal regulations, donor compliance requirements, and international best practices.
• Continuously review and enhance organizational compliance frameworks and policies.
• Foster a culture of ethical behavior and compliance throughout the organization.
Job Requirements:
Education: Bachelor’s degree in Law, Public Administration, International Relations, or related field. A Master’s degree or professional legal certification is strongly preferred.
Experience: - Minimum 5–7 years in legal, compliance, or risk management roles, preferably in NGOs/nonprofits. - Proven experience developing and implementing compliance systems and policies. - Strong knowledge of Afghan laws and NGO regulations. - Experience with donor compliance (UN agencies, international government grants) is a plus.
Skills & Competencies: - Strong analytical, problem-solving, and decision-making abilities. - Excellent understanding of nonprofit governance and legal frameworks. - High level of integrity, discretion, and professionalism. - Ability to work independently and proactively. - Strong interpersonal and communication skills, including training and mentoring. - Fluency in English, Dari, and Pashto.
