Position Description:
The Government Compliance Officer position is a critical role responsible for ensuring all organizational projects and operations fully comply with government / donor regulations and requirements. The primary focus is on the end-to-end management of the project registration process with the Ministry of Economy (MoEc) and the meticulous drafting, negotiation, and finalization of Memoranda of Understanding (MoUs) with relevant sectoral ministries. The holder of this position serves as the principal liaison between the organization and government bodies, ensuring all project documentation is accurate, compliant, and submitted in a timely manner.
Responsibilities:
Specific Responsibilities:
- Professional and proper representation of the organization during the project registration and MoU process.
- Lead the entire process of project registration with the Ministry of Economy (MoEc), serving as the single point of contact.
- The Government Compliance Officer must be able to address any basic concerns or questions raised by government officials during the process.
- In close coordination with the Technical Unit, draft, review, and revise Memoranda of Understanding (MoUs) with sectoral ministries, ensuring all terms and conditions are clear, mutually agreeable, and legally sound.
- Incorporate and adhere to all relevant government rules, policies, and legal frameworks during the MoU drafting process.
- Review project documents (proposals, logframes, budgets) to ensure the MoU draft aligns with the project's goals, activities, and deliverables.
- Manage the negotiation process for MoUs, coordinating with internal and external stakeholders to reach a final agreement.
- Maintain a centralized repository of all active, expired, and archived MoUs and project registration certificates.
- Manage and keep records of government-related documents, including letters and MoUs.
- Proactively follow up with MoEC and relevant line ministries.
- Provide updates on MoU progress for the donor if requested.
Compliance Monitoring & Reporting

- Serve as the organization's subject-matter proficient on government compliance requirements.
- Prepare and submit all mandatory project reports to government entities (including MoEc and sectoral ministries) according to stipulated schedules.
- Compile and submit detailed financial semi-annual reports to the Ministry of Economy.
- Monitor changes in government policies, regulations, and reporting requirements, and proactively communicate these changes to relevant internal departments.
Internal Coordination & Collaboration

- Finance Department: Work closely with finance colleagues to ensure all project financial documents (budgets, expenditure reports) are prepared in compliance with government rules and are ready for submission.
- Program/Project Staff: Collaborate with program teams to ensure that all project activities, objectives, and outputs are accurately and completely reflected in One Budget Form, MoU and subsequent reports.
- Technical Unit: Liaise with technical unit to obtain necessary technical documents required for MoU.
- Security: Follow the organization’s existing security policies, procedures, and daily instructions for personnel safety.
Relationship Management

- Develop and maintain strong, professional relationships with key officials with the relevant government agencies.
- Represent the organization in official meetings with government counterparts.

Job Requirements:
Education: Bachelor’s degree in law, Public Administration, Business Administration, International Relations, Finance, or related field. A master’s degree in the relevant field is preferred.
Experience: A minimum of 5 years of proven experience in compliance, legal, or external relations and demonstrable experience in drafting, negotiating, and finalizing memorandum of understanding (MoUs) with government entities required.

Languages: Oral & Written fluency in English, Pashto and Dari is required.
